Non-EU/EEA citizens can stay in Spain visa-free for up to 90 days in any 180-day rolling period. This applies to tourists and short-term visitors. Understanding these rules prevents legal problems. This guide explains the rules clearly.

The 90/180 Rule Explained

You can stay 90 days maximum in any 180-day period. This is rolling—it resets continuously. Example: if you arrive January 1 and stay 90 days (until March 31), you can return April 1 but cannot stay more than 90 of the next 180 days (until September 27). After 180 days from your initial entry, the clock resets.

Who This Applies To

All non-EU/EEA citizens without a visa. US, Canada, Australia, UK post-Brexit, etc. EU/EEA citizens can stay longer or indefinitely. Swiss citizens have similar 90/180 rules as non-EU.

Consequences of Overstaying

Fines: 300-600 euros. Deportation: authorities can refuse re-entry. Entry bans: overstayers may be banned from Schengen area (1-3 years). Police records: overstaying is recorded. Future visa denials: overstaying makes future visa harder. It's serious—don't overstay.

Can I Reset the Clock by Leaving?

Technically yes, but it's monitored. Leave Schengen completely (not just to another Schengen country). Your clock resets after the full 180 days from entry. Frequent leaving/returning looks suspicious. Spain can refuse re-entry if it appears you're abusing the rule.

Working While Visa-Free

No. You cannot work on a visa-free stay. Neither employment nor self-employment. Even freelance/remote work technically violates terms. Authorities don't always enforce, but it's prohibited. Remote work is gray area—technically not allowed, but enforcement varies.

Ready for a Longer Stay?

If you need to stay longer than 90 days, apply for a visa. We guide you through the process.

Frequently Asked Questions

Does the 90 days include both entry and exit days?
Yes. Both entry and exit days count. If you arrive Jan 1 and leave Mar 31, that's 90 days.
Can I extend my 90-day stay?
No extension possible on visa-free status. You must leave or apply for a visa before 90 days end.
Do short trips outside Spain reset my clock?
Only if you leave Schengen completely. Trips to France or Portugal don't reset it.
What if I overstay accidentally?
Fines apply. Being unaware isn't a defense. Better to leave early than overstay.
