The terms and conditions governing your use of My Spanish Visa and any services you purchase from us. Please read these carefully before proceeding.
Important notice: Nothing on this website constitutes legal advice. My Spanish Visa connects clients with qualified legal professionals at PLS Platinum Legal Spain. By using our website or purchasing any service, you agree to these Terms of Service in full.
1. About My Spanish Visa
My Spanish Visa ("we", "us", "our") is an information, eligibility assessment, and visa assistance service operated by PLS Platinum Legal Spain. We are not a law firm, and we do not provide legal advice. Our role is to help English-speaking individuals understand Spanish visa and residency options, determine their eligibility, and connect them with qualified immigration lawyers and legal professionals at PLS Platinum Legal Spain who manage their applications.
Any legal advice, document review, or case representation is provided by PLS Platinum Legal Spain acting in their capacity as a regulated Spanish legal services firm — not by My Spanish Visa as a separate entity.
2. Scope of Services
My Spanish Visa offers the following services, as described on our website and confirmed in your service agreement or invoice:
Information and Eligibility
- Free educational content, guides, and FAQs about Spanish visas and residency routes
- An online eligibility quiz to indicate which visa types may be appropriate for your circumstances
- General information about document requirements, income thresholds, and application timelines
Paid Services
- Consultation: A one-to-one video or telephone consultation with an immigration specialist from PLS Platinum Legal Spain to assess your situation and outline your options
- Document Guidance Package: Personalised guidance on preparing your specific document bundle, including checklists, translation advice, and document review
- Full Application Management: End-to-end preparation, submission support, and liaison with the relevant Spanish consulate or immigration authority on your behalf, carried out by PLS Platinum Legal Spain
The specific services included in your engagement are set out in the proposal or invoice agreed with you before payment. Services not listed in your agreement are not included and may be subject to additional fees.
3. Eligibility and Accuracy of Information
You are responsible for providing accurate, complete, and up-to-date information when using our services. Eligibility results from our quiz are indicative only and do not constitute a formal assessment or guarantee of visa approval. Eligibility for Spanish visas is determined by the relevant consulate or Spanish immigration authority, not by My Spanish Visa or PLS Platinum Legal Spain.
We make every effort to keep the information on our website accurate and current. However, Spanish immigration law and requirements change regularly. We cannot guarantee that all content is up to date at the time you read it. Always confirm requirements with the relevant consulate before submitting an application.
4. Payment Terms
Payment for paid services is required in advance unless otherwise agreed in writing. Prices are quoted in Euros (EUR) unless stated otherwise, and are inclusive of Spanish VAT (IVA) where applicable.
Instalment Option
For full application management packages, we offer a 3-instalment payment plan to spread the cost of your service fee:
- Instalment 1 (Onboarding): 40% of the total service fee, due upon signing your service agreement
- Instalment 2 (Document Stage): 35% of the total service fee, due when your document bundle is completed and ready for submission
- Instalment 3 (Submission): 25% of the total service fee, due upon submission to the consulate or immigration authority
Instalment terms are available on application management packages only. Consultations and document guidance packages require payment in full at the time of booking. Instalments are non-refundable once the corresponding stage of work has been completed.
Payment Methods
We accept payment by credit or debit card via our secure payment provider, and by bank transfer for amounts over €1,000. Payment details are provided on your invoice. Government fees (consulate fees, TIE application fees, etc.) are separate from our service fees and are payable directly by the client.
5. Cancellation and Refund Policy
Consultations
Consultation fees are refundable if you cancel with at least 48 hours' notice before your scheduled appointment. Cancellations within 48 hours of the appointment, or failure to attend without notice, are non-refundable. You may reschedule a consultation once at no charge, provided you do so with at least 24 hours' notice.
Document Guidance and Application Management
Where work has commenced on your case, fees for completed stages of work are non-refundable. If you wish to cancel your engagement:
- Before work begins: a full refund of any amounts paid will be issued within 14 days
- After work begins but before the first milestone: a refund of 50% of the first payment, reflecting administrative costs already incurred
- After the first milestone is completed: no refund for the completed stage; any remaining instalments are cancelled
Refund requests must be submitted in writing to our contact page or by emailing our team directly. We aim to process all refund requests within 14 business days.
6. Limitation of Liability
To the fullest extent permitted by applicable law, My Spanish Visa and PLS Platinum Legal Spain shall not be liable for:
- Any decision made by a Spanish consulate, embassy, or immigration authority in relation to your visa or residency application
- Delays in consulate processing times, appointment availability, or government administration beyond our control
- Any loss arising from inaccurate, incomplete, or outdated information provided by you
- Changes in Spanish immigration law or requirements that affect your application after your service agreement is signed
- Any indirect, consequential, or incidental losses including loss of earnings, travel costs, or relocation expenses
Our total liability to you for any claim arising from our services shall not exceed the total fees paid by you for the specific service giving rise to the claim.
7. Your Obligations
By engaging our services, you agree to:
- Provide accurate, complete, and truthful information about your personal circumstances, finances, and immigration history
- Respond promptly to requests for documents or information from our team
- Inform us immediately of any change in your circumstances that may affect your application
- Not submit fraudulent, forged, or misleading documents — doing so may constitute a criminal offence and will result in immediate termination of our services without refund
- Pay all invoiced amounts by the due date specified
8. Intellectual Property
All content on this website — including text, guides, tools, graphics, logos, and the My Spanish Visa brand — is owned by or licensed to PLS Platinum Legal Spain. You may not reproduce, redistribute, or repurpose our content without prior written permission. Personal use (reading, saving, printing for your own use) is permitted.
9. Third-Party Links and Tools
Our website contains links to third-party websites including Spanish government portals, consulate websites, and partner tools. These links are provided for your convenience only. We do not control, endorse, or accept responsibility for the content or practices of any third-party website.
10. Termination
We reserve the right to suspend or terminate our services to you at any time if: you breach these Terms; you provide false information; your conduct is abusive toward our team; or if continuing the engagement would breach professional obligations. In the event of termination by us without cause, we will refund fees proportionate to any uncompleted work.
11. Changes to These Terms
We may update these Terms of Service periodically to reflect changes in our services or applicable law. Material changes will be communicated to active clients by email. Continued use of our website or services after any change constitutes acceptance of the updated Terms.
12. Governing Law and Dispute Resolution
These Terms of Service are governed by and construed in accordance with the laws of Spain. Any dispute arising from or in connection with these Terms shall first be referred to mediation through a mutually agreed mediator. If mediation is unsuccessful, disputes shall be subject to the exclusive jurisdiction of the courts of Spain.
For clients based in the United Kingdom, your statutory rights under UK consumer law are not affected by these Terms. UK-based clients may also seek resolution through the UK Small Claims Court for disputes up to £10,000.
